I had been doing some superficial research on Deputy Sheriff Gilmer Hernandez when I received a letter his wife (their attorney's) had sent out, en masse. I was taken aback by the situation mainly because Mr. Hernandez was gathering support for violating someone’s HUMAN rights, not rights as a citizen since the individual Mr. Hernandez is accused of injuring was not and is not a citizen. I was under the impression that HUMAN rights still existed in this country. I was proven wrong by the American people who applauded this man for shooting a person whose only crime was trying to find a better living, by changing their condition of existence by the quickest means possible. People used to respect “Give me your tired, poor and hungry”. It was the guiding ideology of the United States of America, but throughout history, the only way the government has used the “tired, poor and hungry” is as cannon fodder. Just take a look at the Irish Immigrants during the American Civil War. Let us not exclude Iraq as another prime example of this new intention of “give me your tired, poor and hungry”. The government was handing out citizenships to any individual with military background and/or training. The United States used to be seen as the beacon for independent minds and for success through toil. Now, it seems that the government sets the hearts of Americans to flame at the mere mention of colors (Orange Alert, Red Alert) and with the mention of the boogey-word "Terrorism".

Getting back on task, Mr. Hernandez, I feel sorry for what has happened to you. I had written this entire blog regarding your affair and how you were the criminal and humanity was the victim, but I destroyed it in favor of what you find before you. It took me a while to think through the Counselor's propaganda that came by mail, but thinking through it all I can say that you are both victim and assailant. You will never again find solace in your heritage and you have done harm to your culture. The only support you gather is that of the WASP-ish middle middle class, upper middle class and those that would rather see us destroy what's left of our culture, I being a Mexican-American. I wish I could support you and your family, but my ethics will not allow me.

To Mr. Ted Poe,
"the stillness of the vast night", was exactly like a movie, sir. I can picture Mr. Hernandez cautiously and with measured steps inch his way into destiny. I can see the driver angrily narrow his eyes as he focused on the lone defender of democracy. The air grew still and quiet, not wanting to reveal the secret it held at its lips. Once Mr. Hernandez reached the location he was fated to be at, he pivoted slowly, and stared into the faces of monsters, ghouls that only came out in the cold night to injure those innocent children that escape the security of their parents. The driver aimed at Mr. Hernandez, dropped his foot on the accelerator and laughed at the young officer of the law as the vehicle roared forward towards its intended victim.

Mr. Poe, as poetic as your oration sounded (below you will find an excerpt), reality is nothing like the movies. The credits will not roll at the end of the film, actors will not step in front of curtains to take their bows. But please, sir, do not lose your childish beliefs because once you grow up, you'll never find your innocence again, especially since the "lone defender of democracy" shot out the rear tire, not the radiator, like in the movies. If you shoot out the rear tires of a vehicle that means you have to be beside and away from the vehicle, AS IT DRIVES AWAY!!!! Fear not, sir, the stillness of that night is safe as long as you defend "democracy".

In the end of it all, I can be as angry as I want to be and the victims will always be guilty and the criminals innocent. Reality is as subjective as it can get without a number of reliable witnesses present, and by reliable witnesses, Mr. Poe would only accept Americans to do the talking, as if it was not an American who bombed the Federal building in Oklahoma City. As an officer of the law, Mr. Hernandez should have sought other means to stop the vehicle other than deadly force because that is exactly what Mr. Hernandez was intending. Once a weapon is drawn there is no other intention than to do harm, that much is fact. I applaud Mr. Hernandez’s ability to survive his encounter, but I do not applaud the means. The means to an end are as important as the end itself, and at the end, Mr. Hernandez, you are where you are supposed to be.

Deputy Gilmer Hernandez, Border Lawman
(Mr. POE asked and was given permission to address the House for 1 minute.)Mr. POE. Mr. Speaker, in the small border town of Rocksprings, Texas, where drug smugglers and human smugglers sneak across the Rio Grande into America, lone Deputy Sheriff Gilmer Hernandez was on patrol. In the stillness of the vast night, a speeding Suburban runs a red light. Deputy Hernandez, 25, stops the vehicle, but suddenly, without warning, the vehicle takes off. Deputy Hernandez says the vehicle tried to run him down. The lawman fires several shots, one of which shoots out the rear tire, just like in the movies.The vehicle stops, and eight or nine illegals jump out and take off running into the sagebrush. One illegal had a minor injury from a bullet. The U.S. Government rounds up six or seven of the illegals and, guess what, prosecutes Deputy Hernandez, claiming he recklessly discharged his firearm and uses the illegals as witnesses against the lawman during a trial.Citizens of his town are mad. One said, ``Our deputy's in jail for doing his job.''Mr. Speaker, another example of how the Federal Government is more concerned about people illegally invading America than it is about the men who protect America. Once again, our government is on the wrong side of the border war.And that's just the way it is.
